What Texas Event Hosts Need to Know

Texas has specific alcohol-liability rules that apply to any event serving or providing alcohol. Under the Texas Dram Shop Act (Alcoholic Beverage Code §§ 2.01–2.03), a provider can be held liable if they serve alcohol to an obviously intoxicated person who later causes injury or property damage.

Key Requirements for Texas Events

Serving or Selling Alcohol

  • If you sell alcohol at an event (for example: selling drinks, requiring drink tickets, charging admission that includes alcohol), you generally must obtain the appropriate TABC temporary event authorization.
  • Some temporary authorizations require advance submission; timing varies by permit type and event specifics.
  • Fees are set by permit type—there is no universal state “late fee” schedule.

Serving Free Alcohol

  • If alcohol is truly free with no direct or indirect charge or benefit, a TABC permit is usually not required.
  • However, if guests pay an entry fee, donate, or purchase anything of value in exchange for access to alcohol, TABC may consider it a sale, triggering permit requirements.

Dram Shop Liability & Safe Harbor

  • Dram shop liability applies when someone is overserved despite showing obvious signs of intoxication and later causes harm.
  • Licensed providers may reduce or avoid liability under the TABC Safe Harbor Defense if:
    1. Employees completed a TABC-approved seller-server training program,
    2. The provider maintained proper training records, and
    3. Management did not encourage violating the law.
  • Note: Safe Harbor applies to licensed providers, not all private hosts.

Insurance Considerations for Event Hosts

Even when TABC does not require a permit:

  • Many Texas venues require event hosts to carry general liability insurance, often with the venue named as Additional Insured.
  • Coverage requirements commonly include $1,000,000 per occurrence / $2,000,000 aggregate, but limits vary by venue.
  • Host liquor liability is generally included automatically in many event-liability policies when alcohol is served but not sold.

Outdoor Event Considerations (Texas Heat)

While not part of TABC law, Texas outdoor events face extreme temperatures—regularly over 100°F in summer months.
Event organizers often consider optional insurance such as:

  • Weather insurance (including heat-triggered parametric coverage)
  • Event cancellation or postponement insurance
